Terms of Use

1.Acceptance of these terms

Safe Cheque is operated by SAFELEX Trust, a Bengaluru-based public charitable trust. By creating an account, uploading a cheque, generating a document, or signing an agreement on this platform, you agree to these Terms of Use, our Privacy Policy and our Disclaimer. If you do not agree, you must not use the platform.

2.Eligibility

You may use Safe Cheque only if you are at least 18 years of age, competent to contract under the Indian Contract Act, 1872, and are using the platform in respect of a cheque transaction to which you are a genuine party (as drawer, payee, or an invited witness). You must be resident in India or otherwise legally able to enter into cheque transactions governed by Indian law. Accounts may not be created on behalf of another person without that person's written authority.

3.Account responsibilities

You are responsible for the accuracy of every detail you enter, including cheque particulars, bank details, identity information and counterparty contact details. You must keep your login credentials, OTPs and secure invite links confidential, and you are responsible for all activity carried out through your account. Notify us immediately at support@safelex.org if you suspect unauthorised access. SAFELEX Trust is not responsible for losses arising from your failure to protect your credentials or from details you entered incorrectly.

4.Acceptable use

You must not: enter false, forged or fabricated cheque data; impersonate any person or falsely claim to be a party or witness to a transaction; upload a cheque image you are not lawfully entitled to hold; use the platform to harass, threaten or coerce another person; attempt to obtain another user's personal data; probe, scrape, reverse-engineer, or interfere with the platform, its security controls or its underlying systems; or use the platform for money laundering or any other unlawful purpose. Generating a demand notice or petition draft with knowingly false particulars may itself attract criminal liability.

5.Your content and intellectual property

You retain ownership of the data and documents you submit — your cheque images, transaction particulars, identity details and signatures. You grant SAFELEX Trust a limited, non-exclusive, royalty-free licence to store, process, render and reproduce that content strictly for the purpose of operating the platform: validating cheques, generating and delivering agreements, notices and petition drafts, maintaining the audit trail, and complying with legal obligations. This licence ends when the content is deleted in accordance with the retention schedule in our Privacy Policy. Documents generated for you are yours to use, print and file.

6.Our intellectual property

The Safe Cheque platform, its source code, validation logic, agreement templates, notice and petition formats, design, branding and documentation are the intellectual property of SAFELEX Trust, except where a component is separately licensed or attributed. You may not reproduce, distribute, reverse-engineer, or use them to build a competing product or service without the Trust's prior written permission.

7.Service limitations and no uptime guarantee

Safe Cheque is provided on an "as is" and "as available" basis as a free social-awareness initiative. We give no guarantee of uninterrupted availability, and the platform may be suspended at any time for maintenance, security or operational reasons. Validation results, statutory date calculations, OCR extraction from cheque images and generated document drafts are aids only and may contain errors; you remain responsible for verifying every particular and every deadline with a qualified advocate. Safe Cheque does not process payments, does not hold funds, is not a bank or NBFC, and is not regulated by the Reserve Bank of India.

8.No representation, no advocate-client relationship

The Safe Cheque team does not represent, appear for, or act as an advocate or authorised agent for any user before any court, tribunal, police station, bank or authority. Use of the platform does not create an advocate-client relationship. See our full Disclaimer for details.

9.Suspension and termination

We may suspend or terminate your access, with or without prior notice, if you breach these Terms, if we reasonably suspect fraudulent, impersonating or unlawful use, if your account is dormant for an extended period, or if required by law or by a court, regulator or law-enforcement direction. You may close your account at any time by writing to support@safelex.org; records already forming part of a signed agreement or an active dispute will be retained for the periods set out in the Privacy Policy. Clauses relating to intellectual property, limitation of liability and governing law survive termination.

10.Limitation of liability

To the fullest extent permitted by law, SAFELEX Trust, its trustees, staff, volunteers and legal support panel shall not be liable for any indirect, incidental or consequential loss, or for any loss arising from reliance on validation results, generated documents, calculated deadlines, or platform downtime. Nothing in these Terms excludes liability that cannot lawfully be excluded.

11.Changes to these terms

We may update these Terms from time to time. The version number and last-updated date at the top of this page will change when we do. Continued use of the platform after an update constitutes acceptance of the revised Terms.

12.Governing law and jurisdiction

These Terms of Use, and any dispute or claim arising out of or in connection with the Safe Cheque platform, its content, or any document generated through it (whether contractual or non-contractual), are governed by the laws of India. The courts at Bengaluru, Karnataka shall have exclusive jurisdiction. This clause is the primary source of truth on governing law and jurisdiction for the entire platform, and the corresponding statements in the Disclaimer and Privacy Policy are to be read as references to it.
