Safe Cheque is an initiative of SAFELEX Trust, provided to help users record, validate, and formalize agreements relating to cheque transactions, and to assist with document preparation if a cheque is dishonoured. Please read this disclaimer carefully before using the platform.
1.A social-awareness initiative — no representation
Safe Cheque is run as a social-awareness and legal-literacy initiative of SAFELEX Trust. The Safe Cheque team does not represent, appear for, or act as an advocate or authorised agent for any user who signs up on the platform, whether before a court, tribunal, police station, bank, or any other authority. Signing up, generating documents, or contacting the support team does not create an advocate-client relationship. Any representation must be arranged independently by the user with an advocate of their own choosing.
2.What the generated documents do
Documents generated through this website — cheque transaction agreements, Section 138 demand notices, and petition drafts — are prepared from the particulars entered by the users themselves. They serve to support and record the transaction details and the agreement between the parties. They are not filings made by Safe Cheque, do not bind any court or bank, and must be reviewed, adapted, and signed, sent, or filed by a qualified advocate.
3.Not a bank or payment system
Safe Cheque is not a bank, non-banking financial company (NBFC), or a payment system operator regulated by the Reserve Bank of India (RBI). The platform does not process payments, hold funds, or guarantee that any cheque will be honoured or that the drawer's account holds sufficient funds. All cheque clearance and fund-related outcomes remain solely between the parties and their respective banks.
4.Validation is indicative, not conclusive
The validation checks performed by Safe Cheque (date validity, amount consistency, MICR/IFSC format, crossing type, Positive Pay System applicability, and similar checks) are based on publicly available Reserve Bank of India guidelines, including Cheque Truncation System (CTS-2010) standards and the Positive Pay System framework, and on the Negotiable Instruments Act, 1881. These checks are provided as a convenience to help users spot common issues and do not constitute a guarantee that a cheque will be accepted, cleared, or held valid by any bank or court.
5.Identity verification is not full KYC
Mobile number and Aadhaar-based OTP verification on Safe Cheque is used solely to identify the parties to a cheque transaction to each other. It does not constitute Central KYC (CKYC), does not substitute for a bank's own account-opening KYC process, and should not be relied upon as proof of creditworthiness or account status.
6.Not legal advice
Safe Cheque provides document templates, including cheque agreements and draft legal notices or petitions relating to Section 138 of the Negotiable Instruments Act, 1881, for informational and drafting-assistance purposes only. Use of the platform does not create an advocate-client relationship between any user and SAFELEX Trust, its staff, volunteers, or affiliated legal support panel. Any document generated by Safe Cheque, including agreement drafts, legal notice drafts, and petition drafts, must be reviewed by a qualified advocate before it is signed, sent, or filed. Statutory timelines shown by the platform (including cheque validity, notice periods, payment windows, and complaint-filing deadlines under Sections 138 and 142) are calculated based on the dates entered by users and general statutory provisions; users remain responsible for independently confirming all applicable deadlines with a qualified advocate, since case-specific facts can affect how these timelines apply.
7.Data protection
Safe Cheque processes personal data, including mobile numbers, Aadhaar-linked verification data (limited to the last four digits and a verification status, never the full Aadhaar number), PAN, bank account details, cheque images, and agreement records, in accordance with the Digital Personal Data Protection Act, 2023, and the practices set out in our Privacy Policy. Users are encouraged to review the Privacy Policy for details on data collection, retention, and their rights as data principals.
8.Limitation of liability
SAFELEX Trust and Safe Cheque make no warranty, express or implied, regarding the completeness, accuracy, or legal sufficiency of any validation result, agreement, or document generated through the platform. To the fullest extent permitted by law, SAFELEX Trust shall not be liable for any loss, damage, or legal consequence arising from reliance on the platform's outputs, including missed statutory deadlines, disputes between parties, or dishonoured cheques.
9.Governing law
This disclaimer and the use of Safe Cheque are governed by the laws of India, and any dispute is subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka. The governing-law and jurisdiction clause in our Terms of Use is the primary source of truth on this point and this statement is to be read as a reference to it.
